By accessing or using DealerSpark GEO (the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a dealership or other organization, you represent that you have authority to bind that organization.

2. Seller Information

The Service is provided by Echo Range Ai LLC, DBA DealerSpark ai ("we," "us," or "our"). You are contracting with Echo Range Ai LLC for your use of the Service.

3. Description of Service

DealerSpark GEO provides monitoring, diagnostics, and reporting related to how artificial intelligence search engines and large language models represent your dealership. Outputs are informational and do not constitute legal, financial, or marketing advice.

4. Account and Access

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

5. Acceptable Use

You agree not to:

• Reverse-engineer, scrape, or resell the Service without written permission.
• Use the Service to infringe intellectual property or violate applicable law.
• Attempt to bypass rate limits, access controls, or security measures.
• Use the Service to defame competitors or publish knowingly false information.

6. Third-Party AI Providers

The Service queries third-party AI systems (such as OpenAI, Google, and Perplexity) on your behalf. Their outputs are provided as-is and may be inaccurate, incomplete, or biased. We are not responsible for third-party content surfaced through the Service.

7. Customer Data

You retain ownership of the dealership information, competitor lists, and other data you provide. You grant us a limited license to process that data to operate and improve the Service.

8. Fees, Subscriptions, and Billing

Paid features are billed according to the plan you select. Subscriptions renew automatically for the selected billing period unless canceled. Fees, taxes, billing frequency, cancellation, and refund mechanics are handled by our online reseller, Paddle.com. Please refer to Paddle's Buyer Terms for full details on payment, billing, tax, cancellation, and refunds.

9. Paddle Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Refunds

We offer a 30-day money-back guarantee. If you're not satisfied with your purchase, you can request a full refund within 30 days of your order date. Refunds are processed by our payment provider, Paddle. To request a refund, visit paddle.net or contact our support team.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that AI-generated outputs are accurate or that the Service will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising from or related to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

13. Suspension and Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in the app and you may be asked to re-accept before continuing to use the Service.
